I have a stupid question (another one, I know!) Can I use a picture that portrays a historical figure if I provide a disclaimer? Or does that not make it so much of an original fiction?

Well considering that photography is considered to be a form of art I don't see why not, as long as the story is about the person themselves not someone they portrayed if they are an actor. That would be considered fan-fiction.
Did that make sense?

That makes sense, M. The one I want to base a story on is a painting of a historical pirate. lol, I can't get away from those bloody pirates. =D
